LITIGATION SUMMARY: Plaintiff Randi Hodrick filed this putative class action for alleged violations of Florida Statute § 83.49, the Florida Residential Landlord Tenant Act (“FRTLA”) arising out of security deposit withholding practices by KPM Management. KPM agreed to resolve this matter, but then after Final Approval,refused to make payment on the settlement. However, KPM did waive all outstanding debt obligations. Thereafter, Class Counsel pursued KPM’s parent company, Nitya Capital for the amounts owed to the Class, totaling $350,000, plus interest. Plaintiff took the deposition of Nitya Capital’s Chief Financial Officer and obtained financial records. After additional litigation, Nitya Capital and Swapnil Agarwal agreed to make payments under a payment plan starting April 1, 2026 in the amount of $50,000 per month. On December 1, 2026, when the payments total $400,000, the claims administrator will issue payment to the Class pursuant to the settlement terms. After Nitya Capital and Swapnil Agarwal make full payment, all Class Members will release KPM Management, Nitya Capital, Swapnil



MONETARY BENEFITS: Nitya Capital will establish a common fund of $381,800 to provide a refund payment of up to 50% of the securitydeposit amount to each Settlement Class Member who does not opt out of the Settlement Class. If a Class Member has a balance remaining, then will receive 27.6% of their deposit returned. Each class member will receive an additional $13.71 in post-judgment interest. ATTORNEYS’ FEES: Nitya Capital separately agreed to pay Plaintiff’s counsel $274,000.00 in attorney’s fees and costs.

OPT OUT: Your opportunity to opt-out of this settlement already occurred. If you did not opt-out before, then you are bound by this additional settlement and will be administered relief accordingly.
